Jackie Harrison - killed by drunk driver-june 8th-2002

we will always remember you Jackie.
So loving and kind and thoughtful.this site has been made for you..we will continue to fight for justice, for your senseless death.you had so many plans for your future..then on June 8th 2002,the drunk driver (a repeated offender)took your hopes and dreams away.he took you from us so horribly.no one should die the way you did.On that Day June 8th 2002,you and Sheena wanted to ride your bikes to the store,so you could buy things for your new job you were going to start on Monday, and as always, you bought things for Little Joshua, the apple of your eye, your 3 year old nephew.on the way home..he struck you and Sheena from behind at a considerable rate of speed, throwing you up in the air onto his truck, your head hit the windshield,im told you died instantly,my baby..im told you traveled 175 feet on the truck before you were threw off and he run over you..my God, what he did too you, blunt force injuries to head and neck, brainstem damage, fractured thyroid cartilage, both legs broke,7 broken ribs, puntured lung.abrasions and lacterations all over your body.bleeding internally, liver damage and more, police tell me you were pinned under right front side of truck and both bikes were entangled and crumpled under left front side of truck. All Sheena remembers is coming to and seeing herself coverd in blood and you..her Sis under the truck.she spent a great deal of time in wheelchair and bed.she almost lost her left leg.her right leg was broke.she had a concussion and other injuries.our family is not whole anymore,my heart is tore apart..the drunk driver has such a horrible history of drunk driving..and having incidents..i dont call them accidents because accidents are unpreventable..drinking and driving and hurting or killing someone is preventable.this guy was released on House Arrest Sept 3 2002, until he is sentenced Oct 11 2002,so he can organize his life and say his goodbyes before he goes to prison.i did not want this as i told them..you didnt get to organize your life or say your goodbyes before he sentenced you to death.he got Married on Oct 1 ,isnt it odd ,how his life can go on like he did nothing wrong.how you were supposed to go Lansing that week for a seminar with 4 of your friends, you went.but 4 days ahead of schedule,in a cold lonely dark body bag.remember how you planned a fathers day dinner for your father, instead we buried you 2 days before fathers day.and how much you wanted to see Joshua turn 3...Do you hear Joshua when we come to vist you at cemetary singing Twinkle Twinkle little star to you,can you feel him sitting on your grave, like he used to sit on you when you play wrestled?did you hear him say,i love you Gee,come home and when he asked me if you were nite nite.did you hear me say quitely yes..she is nite nite forever.we love you JackIe so much.

OUR JUSTICE SYSTEM NEEDS TO CHANGE

Mother: Drunk driver's sentence not enough
ALLEGAN (NEWS 3) – A drunk driver was sentenced Friday to 7 to 15 years in prison for an accident that killed a 22-year-old woman.
According to police, Jerry Key Jr. had a blood alcohol level of .22 when he crashed into
Jacquelyn Harrison last June. Harrison and her 16-year-old sister were riding their bikes along 56th Street in Allegan County.
"In some respects, what you did is no different then if you took gun and shot her," Allegan Co. Circuit Court Judge Harry Beach told Key.
After the sentencing, Jacquelyn's mother said she was disappointed that Key, who was driving on a suspended license and had been arrested for driving drunk last year, did not get a longer sentence.
"It just can't keep happening," said Harrison. "They just can't go out, kill somebody by drunk driving, get a few years in prison and get out." >>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>
Jerry Key will eligible for parole in 7 years...this is for the death of Jackie and serious injury of Sheena.but i will be there to fight the release.i believe such deaths should be considered murder,as the repeated offender/drunk driver KNOWS what could happen and how dangerous it is. as Judge Beach said ",in some aspects it was no different than if he shot her with gun." a gun is a weapon and so is a vehicle if not handled properly.it may not have been intent or premeditated murder, he still took a life and it was preventable{murder without intent.i have done some research on this and there are states that will prosecute a drunk driver who has caused death with first or second degree murder.i will be adding links that show such cases. i hope everyone who vists this website will help me fight in changing our justice system..and keep visting this site for updates and other things i have added.

interesting info on drunk driving charges

vFictionAn impaired driver who kills someone cannot be charged with murder.FactThe only difference between a vehicular homicide and other homicides is the use of a motor vehicle as a weapon, as opposed to a gun or knife. This does not change in any way the elements required to be proved for murder. As long as the elements for murder can be proved, a vehicular homicide defendant can be tried for murder just like someone who uses a gun.FictionA motor vehicle is not a deadly weapon, like a gun.FactA motor vehicle's purpose is to transport people from one place to another. However, under the right circumstances, motor vehicles become as deadly, if not deadlier, than guns. The latest statistics show that almost twice the number of people die in vehicle crashes per year than by all other forms of homicide combined. And more people are killed in alcohol-related crashes per year than are killed by firearms. Courts across the country do not equate motor vehicles with guns if used as they are intended to be used. But if the operator intends to use the vehicle as a weapon, then motor vehicles and guns are equally effective weapons.FictionImpaired drivers can use the excuse that they were too drunk to know what they were doing.FactImpairment due to alcohol or other drugs is never a complete defense for any crime. But it can be used as a partial defense. This occurs if the defendant is charged with murder or voluntary manslaughter and the defendant's impairment level is so high that it affects the defendant's intent to kill. When this happens, murder and voluntary manslaughter are only mitigated to a lesser crime, like involuntary manslaughter or criminally negligent homicide. However, this is a rare occurrence and no court has ever established an impairment level at which this happens.FictionIf my state has already enacted a vehicular homicide statute, an impaired driver who kills cannot be charged with murder or manslaughter.FactVehicular homicide statutes were enacted so prosecutors could avoid the obstacles they faced in using murder and manslaughter statutes to prosecute vehicular fatalities (i.e., convincing jurors that a vehicle is just as much a weapon as a gun and that an impaired defendant may be just as guilty as a sober defendant). However, no court has ever found that when state legislatures enacted vehicular homicide statutes, they also prohibited the use of the more traditional murder and manslaughter statutes.FictionAn impaired driver never intends to kill anyone, and without this intent to kill, the driver cannot be convicted of murder.FactWhile it is true that few impaired drivers who kill begin their evenings looking to do so, their actions throughout the evening can be so egregious that the law implies an intent to kill. Once that implied intent to kill is established, any impaired driver who kills can be convicted of second degree murder.FictionCapital punishment is a sentencing option in my state, but impaired drivers cannot get the death penalty.FactIt is rare that an impaired driver who kills is charged with first degree murder. It is even rarer that an impaired driver who kills is charged with capital murder. However, two states, North Carolina and Kentucky, have charged impaired drivers with capital murder. These states have not created any new law; they have simply used the existing capital murder law and applied that law to the facts of the vehicular homicide. If a vehicular homicide case meets all of the statutory criteria for capital murder, there is no reason the case cannot be charged as such.

DRUNK DRIVERS CAUSING DEATH-MURDER?

23-year-old Detroit man was arraigned on
murder charges Monday in a crash that killed a Canadian family of five.
Paxton V. Boyd is charged with five counts of second-degree murder. Police say he was driving drunk when he slammed his sport-utility vehicle into the Courtright, Ontario, family's car Sunday. According to a witness, Boyd was traveling up to 70 m.p.h., police said.
If convicted, Boyd could be sentenced to life in prison.
"If you're driving a large vehicle at that speed, there's going to be a murder," Assistant Wayne County Prosecutor Kevin Simowski said.
Killed were Richard Wilson, 51; his wife, Bonnie, 48; their children Alicea, 24, and Mark, 22, and 3-year-old grandson Andrew. They were on eastbound 8 Mile near Hoover in Detroit, returning home from the Toledo, Ohio, wedding of Jacob Williams, the son of a close friend of Richard Wilson.
"We were supposed to grow old together; have fun together. He was my friend for 25 years," Larry Williams said.
Since 1992, Boyd received a total of eight speeding tickets, according to Michigan Secretary of State records.
He got two points on his license in 1996 when he was driving 50 m.p.h. in a 40 m.p.h. zone in Oak Park. In September 1997, he received three points for going 75 m.p.h. in a 55 m.p.h. zone in Detroit. One month later, he got two points for going 35 m.p.h. in a 30 m.p.h. section of Detroit. In order for his license to be restricted or suspended, he would have to accumulate 12 points within a two-year period, according to the office.
Monday's arraignment took place in 36th District Court before Magistrate Margaret Baylor. The other grandfather of 3-year-old victim Andrew Wilson was present but did not comment.
Boyd's preliminary hearing is July 27 in 36th District Court.

police say

GAZETTE NEWS SERVICE
PULLMAN -- Police say a man who was convicted last year of drunken driving was drunk this weekend when his pickup struck two sisters on their bicycles, killing one and seriously injuring the other.
Jerry Don Key Jr., 29, of Pullman was jailed on $100,000 bond by Allegan County District Court Magistrate Kirby Goodwin. Jacquelyn Harrison, 22, of Pullman was killed, while her sister, Sheena Harrison, 16, was seriously injured in Saturday's accident. Police said the case was frustrating and pointed out the difficulty in getting bad drivers off the road. Key's driver's license was suspended last fall when he was convicted of drunken driving, and he did not have insurance, police said.
"I don't know," sheriff's Lt. Rick Cain said. "You put them in jail. That's the only way. Dry them out. Have them go to prison." Detective Chris Haverdink said Key was driving with his 6-year-old son in the truck.
Key was charged with drunken driving causing death, a 15-year felony; drunken driving causing incapacitating injury; drunken driving with an occupant under 16; and second-offense driving while license is suspended.
Key's license was first suspended in 1995 when he failed to stop and identify himself after a crash that injured three people, according to the secretary of state. He was involved in another crash in 1996. No one was injured, but he was cited for driving while his license was suspended.
His license was suspended for a 1997 joyriding incident, but he paid his reinstatement fee later that year and had his license restored. Last fall, he was arrested in Allegan County for drunken driving and had his license suspended through the end of May. It remained suspended because he did not pay the reinstatement fee, the state said. The victims were riding bicycles around 7:50 p.m. Saturday on 56th Street in Lee Township, in southern Allegan County, when Key's Chevrolet S-10 struck them from behind.
The crash devastated parents Susie and Alfred Harrison. They were protective of their daughters, who have learning disabilities and physical handicaps, but wanted them to live normal lives. Their mother wanted their father to drive them into town, but they wanted to ride their bikes.
Jacquelyn Harrison was supposed to start a new job Monday. Driver was drunk -- again, police say

Inside Stories

Key enters guilty plea
By Daniel G. Kelsey, Staff WriterSeptember 04, 2002
Jerry Don Key Jr., 29, of Pullman pleaded guilty Tuesday, Sept. 3, to a felony count of operating under the influence of liquor causing death and a felony count of OUIL causing major injury. In a plea agreement, prosecutors dropped charges against Key of OUIL with a passenger under 16, habitual offender and driving on a suspended license.
Key said he drank beer before driving a pickup that struck two sisters riding bicycles along 56th Street south of Pullman June 8. Jacquelyn Kay Harrison, 22, of Pullman died in the crash and Sheena Marie Harrison, 16, sustained serous injuries. He said his blood alcohol measured .22 in breath and blood tests following the crash.
"I didn't see them," Key said. "They were in front of the car in front of me."
Judge Harry A. Beach modified a bond in the case to allow house arrest for Key until his sentencing Oct. 11. Key faces penalties up to 15 years in prison and $10,000 in fines for OUIL causing death and up to five years in prison and $5,000 in fines for OUIL causing major injury

AND GOD SPOKE

The man whispered, "God, speak to me", and a meadowlark sang.
But, the man did n
ot hear.
So the man yelled "God, speak to me", and the thunder rolled across the sky.
But, the man did not listen.
The man looked around and said, "God let me see you", and a star shined brightly.
But the man did not notice.
And, the man shouted, "God show me a miracle",
and a life was born.
But, the man did not know.
So, the man cried out in despair, "Touch me God, and let me know you are here". Whereupon, God reached down and touched the man.
But, the man brushed the butterfly away
and walked on.
Don't miss out on a blessing because it isn't packaged the way you expect it to be

GODS LITTLE ANGELS

Here for just awhile
God sends his angels to us
To brighten our days and nights
For just awhile they stay here on earth
When they have filled our lives full of love
God carries these little angels home
We miss them still everyday

Our heart and souls are lost and empty
But yet no tears they want us to shed
In the wind they whipser to us
Remember the joy and the love we shared
With each passing day we feel their love
As they come to us and as they leave us
Just remember even though they arnt here
Your life was touched in the most wonderful way
You was loved by one of gods little angels

For Jacquelyn Kay Harrison, my sister... forever one of gods little angels born on 01/11/1980
